利用規約

この利用規約（以下「本規約」）は、森谷 浩幸（屋号：TrendsAI。以下「当方」）が提供する匿名化アプリ「tokumei」および英語版「Swapback」（以下あわせて「本アプリ」）の利用条件を定めるものです。本アプリをダウンロード、インストールまたは使用した時点で、本規約に同意したものとみなします。

第1条（使用許諾）

当方は、本アプリを購入した方（以下「利用者」）に対し、本規約に従って本アプリを使用する、譲渡できない非独占的な権利を許諾します。1つのライセンスは、利用者本人が使用する Mac であれば台数を問わず使用できます。他人との共有や譲渡はできません。

第2条（権利の帰属）

本アプリに関する著作権その他の知的財産権は、当方または正当な権利者に帰属します。本規約は、使用許諾以外の権利を利用者に移転するものではありません。

第3条（同梱ソフトウェア）

本アプリには、第三者が提供するソフトウェアや言語モデルが含まれます。これらには、それぞれの提供元が定めるライセンスが適用されます。

第4条（禁止事項）

利用者は、次の行為をしてはなりません。

• 本アプリの複製、再配布、販売、貸与、ライセンスの譲渡
• 法令で認められる場合を除く、本アプリの逆コンパイル、逆アセンブル、リバースエンジニアリング
• 本アプリを改変し、または改変したものを配布すること
• 法令または公序良俗に反する目的での使用

第5条（匿名化の結果について）

• 利用者は、置き換え後の文章を AI サービスなどに送る前に、内容を自分で確認するものとします。
• 送信するかどうか、何を送信するかは、利用者自身の判断と責任で決めるものとします。

第6条（外部の AI サービス）

ChatGPT など、利用者が本アプリと組み合わせて使う外部サービスは、当方が提供するものではありません。その利用には各サービスの規約が適用され、当方はそのサービスの内容や情報の扱いについて責任を負いません。

第7条（保証の否認）

当方は、本アプリが利用者の特定の目的に適合すること、誤りや不具合がないこと、すべての環境で動作することを保証しません。

第8条（責任の制限）

本アプリの使用に関して利用者に損害が生じた場合、当方は、当方の故意または重大な過失による場合を除き、利用者が本アプリの購入のために支払った金額を上限として責任を負うものとします。

第9条（アップデートとサポート）

当方は、本アプリの不具合の修正や機能の改善のため、アップデートを提供することがあります。ただし、アップデートやサポートを提供する義務を負うものではなく、本アプリの提供を将来にわたって継続することを約束するものでもありません。

第10条（返金）

返品・返金の条件は、特定商取引法に基づく表記に定めるとおりとします。

第11条（本規約の変更）

当方は、必要に応じて本規約を変更することがあります。変更後の本規約は、本ページに掲載した時点から効力を生じます。

第12条（準拠法と管轄裁判所）

本規約は日本法に準拠します。本アプリに関して紛争が生じた場合は、当方の住所地を管轄する地方裁判所を第一審の専属的合意管轄裁判所とします。

Terms of Use

These terms govern your use of the anonymization app Swapback and its Japanese edition tokumei (together, “the App”), provided by Hiroyuki Moriya, doing business as TrendsAI (“we”). By downloading, installing or using the App, you agree to these terms.

1. License

We grant the person who bought the App (“you”) a non-exclusive, non-transferable license to use it under these terms. One license lets you use the App on any number of Macs that you personally use. You may not share it with or transfer it to anyone else.

2. Ownership

All copyrights and other intellectual property rights in the App belong to us or to their rightful owners. These terms give you no rights other than the license above.

3. Bundled software

The App includes software and language models provided by third parties. Each is subject to its own license.

4. What you may not do

• Copy, redistribute, sell or rent the App, or transfer your license
• Decompile, disassemble or reverse engineer the App, except where the law allows it
• Modify the App or distribute modified versions
• Use the App for any unlawful purpose

5. About anonymization results

• Check the masked text yourself before sending it to an AI service or anywhere else.
• Whether to send it, and what to send, is your own decision and responsibility.

6. Outside AI services

ChatGPT and other services you use alongside the App are not provided by us. Their own terms apply, and we are not responsible for what they do or how they handle your data.

7. No warranty

We do not guarantee that the App will suit your particular purpose, be free of errors, or work in every environment.

8. Limitation of liability

Except in cases of our willful misconduct or gross negligence, our liability for any damage arising from your use of the App is limited to the amount you paid for it.

9. Updates and support

We may release updates to fix problems or improve the App. We are not obliged to provide updates or support, and we do not promise to keep offering the App indefinitely.

10. Refunds

Refund conditions are set out on our legal notice page (in Japanese).

11. Changes to these terms

We may update these terms when needed. Changes take effect when they are posted on this page.

12. Governing law and jurisdiction

These terms are governed by the laws of Japan. Any dispute about the App will be brought exclusively before the district court with jurisdiction over our address, as the court of first instance.

This English version is a translation. If it differs from the Japanese version, the Japanese version prevails.
